Terms of Use

By accessing or using HealthEVO at www.healthevo.pro ("Site"), creating an account, or enrolling in a course, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Site. These Terms apply to all visitors, learners, and others who access the Site.

These Terms are governed by the laws of South Australia, Australia. You agree to submit to the exclusive jurisdiction of the courts of South Australia in connection with any dispute arising under these Terms.

The Site is operated by Perioperative Solutions Pty Ltd atf Perioperative Solutions Trust (ABN 34 149 623 950), trading as HealthEVO, Douglas Fahlbusch Healthcare Consulting and DiseaseCare to HealthyCare ("we", "us", "our"). For enquiries, contact admin@douglasfahlbusch.com.

To enrol in a course you need an account. You must:

• be 18 or older, or use the Site under the supervision and with the consent of a parent or guardian
• give accurate and current information, and keep it up to date
• keep your password confidential and not share your account with anyone else
• tell us promptly if you believe your account has been accessed without your permission

Each account is for one person. You are responsible for activity that takes place under your account.

When you enrol in a course, we grant you a personal, non-exclusive, non-transferable licence to access and use that course for your own learning, for the access period stated on the course page. If no access period is stated, access continues for as long as we offer the course on the Site.

We may update, improve or reorganise course content from time to time. Courses described as "coming soon", or offered by expression of interest, are not yet available for enrolment, and registering interest does not guarantee a place, a release date, or a price.

Prices are shown on the Site in the currency stated at checkout and include GST where applicable. Payments are processed securely by Stripe; we do not receive or store your full card number. Your enrolment is confirmed when payment is received.

Our courses come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits those rights.

Beyond those rights, refunds are handled according to any refund terms stated on the relevant course page. If none are stated, please contact us at admin@douglasfahlbusch.com and we will consider your request fairly.

The content on this Site is provided for general educational and informational purposes only. Nothing on this Site constitutes medical, clinical, legal, financial, or professional advice, and it should not be relied upon as such. Course content does not replace your own professional judgement, your organisation's policies, or the advice of a qualified professional regarding any specific matter.

We are not liable for any action taken or not taken based on information provided on this Site. Use of this Site does not create a professional relationship of any kind between you and us.

Certificates of completion confirm that you completed a course on the Site. Whether a course counts towards continuing professional development or any other requirement is decided by your college, registration body or employer.

All content on this Site — including courses, videos, text, articles, publications, workbooks, graphics, logos, images, and the overall design — is owned by or licensed to us and is protected by Australian and international copyright and intellectual property laws.

You may view, download, and print content made available to you for your own personal, non-commercial learning, provided you do not modify the content and you retain all copyright and other proprietary notices. You must not reproduce, republish, distribute, transmit, display, record, share, sell, or create derivative works from any content on this Site without our prior written consent.

You keep ownership of assignments, comments, discussion posts and other content you submit on the Site ("Your Content"). You give us a non-exclusive, royalty-free licence to host, store, display and use Your Content to operate the Site and deliver courses, and to use it in de-identified form to improve our courses.

You must not submit content that:

• includes your own health information or any information that could identify a patient
• includes another person's personal information without their consent
• infringes anyone's intellectual property or other rights
• is unlawful, harmful, offensive, defamatory, or otherwise objectionable

We may remove any content that breaches these Terms.

When using this Site, you must not:

• use the Site for any unlawful purpose or in any way that violates applicable laws or regulations
• attempt to gain unauthorised access to any part of the Site, other users' accounts, or the underlying systems
• transmit any material that is harmful, offensive, defamatory, or otherwise objectionable
• use automated tools to scrape, crawl, download, or extract data or course content from the Site without our prior written consent
• impersonate any person or entity, or misrepresent your affiliation with any person or entity

We may suspend or close your account if you breach these Terms, including by sharing your account or course content. You may close your account at any time by contacting us. Sections 7, 8, 9, 13 and 14 continue to apply after your account is closed.

The Site may contain links to third-party websites, and it relies on third-party services such as our learning platform provider and payment processor. These links are provided for your convenience only. We do not endorse, control, or accept responsibility for the content, privacy practices, or terms of any third-party site. You access linked sites at your own risk.

Subject to section 6, the Site and its content are provided "as is" and "as available" without any warranty of any kind, whether express or implied. To the maximum extent permitted by law, we disclaim all warranties, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We reserve the right to modify, suspend, or discontinue the Site or any course at any time. Where we discontinue a course you have paid for, we will give you reasonable notice or another fair remedy.

To the maximum extent permitted by applicable law, we and our officers, employees, agents, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Site or its content — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or the Site will not exceed the greater of the amount you paid us for the relevant course and AUD $100.

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.

Your use of the Site is also governed by our Privacy Policy at www.healthevo.pro/privacy and our Cookie Policy at www.healthevo.pro/cookies, which are incorporated into these Terms by reference.

We may update these Terms from time to time. The current version will always be available at www.healthevo.pro/terms. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms. Changes will not reduce your access to a course you have already paid for.
